Terms of Service

1. Acceptance

By accessing or using PuffPix ("Service"), you agree to these Terms. If you do not agree, do not use the Service. PuffPix is a trade name of XDMEDIA, a business registered in the Netherlands (KvK nr. 54185904), hereinafter referred to as "we", "us", or "our".

2. Nature of the Service

PuffPix provides browser-based and API-based image compression, as well as a free browser-based AI background removal tool. The Service is provided "as is" and "as available." We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

Image compression is a process that permanently alters image data. By using the Service you acknowledge that:

• Compressed output files may differ visually from the originals, depending on format, settings, and image content.
• Size reduction estimates shown in the tool are indicative only and are not guaranteed. Actual output file sizes depend on image content and may differ significantly from estimates.
• The "Target file size" feature is a best-effort feature. We do not guarantee that any specific output file size will be achieved. If the target cannot be reached, the smallest achievable result is returned.
• GIF, PNG, and already-compressed images may show little or no size reduction.

3. File integrity and backups

PuffPix processes images on a temporary basis and does not retain or back up your original files. In particular:

• Folder (in-place) mode permanently overwrites your original files on your device with the compressed versions. This operation cannot be undone.
• It is your sole responsibility to maintain backups of all original files before using the Service, especially before using Folder mode.
• We are not liable for any loss, corruption, or alteration of image data resulting from use of the Service, including but not limited to failure of the compression process, unexpected interruption, or browser crashes during folder processing.
• Server-side compressed files are stored temporarily and deleted automatically within 30 minutes. We do not guarantee their availability beyond that window.

3a. Background removal tool

The background removal tool uses open-source AI models (U-2-Net / U-2-Netp, MIT licensed) that run entirely within your browser via WebAssembly. By using this tool you acknowledge that:

• AI-generated background removal results are approximate and may vary in quality depending on image content, subject type, and edge complexity.
• We do not guarantee that any specific subject will be correctly isolated or that all background pixels will be removed.
• The model file (~5–176 MB) is downloaded from Hugging Face's CDN on first use and cached in your browser. You are responsible for ensuring sufficient free storage on your device.
• Your images are processed entirely locally. No image data is transmitted to our servers or any third party.

4. Browser compatibility

Certain features of the Service require specific browser support:

• Folder (in-place) mode requires a Chromium-based browser (Chrome or Edge). It is not supported in Firefox, Safari, or other browsers that do not implement the File System Access API.
• Private mode requires WebAssembly support, available in all modern browsers.
• Background removal tool requires WebAssembly and Cache Storage API support. It is supported in all modern desktop and mobile browsers. Approximately 5–180 MB of free browser cache space is required.

It is your responsibility to verify that your browser supports the features you intend to use before purchasing a plan. We are not liable for features being unavailable due to browser limitations. No refund will be issued on the basis of browser incompatibility.

5. API keys and subscriptions

• Paid plans (Starter, Pro) grant you an API key tied to your email address.
• You are responsible for keeping your API key confidential. Do not share it.
• Subscriptions renew automatically each billing period. You may cancel at any time via [email protected] or through your Stripe customer portal.
• Cancellation takes effect at the end of the current billing period. Access continues until then.
• Plan limits (file size, daily compressions) apply per the plan description at the time of purchase. We reserve the right to adjust limits with 30 days' notice.

6. Payments and refunds

• All payments are processed by Stripe and are in EUR.
• Subscriptions are non-refundable except where required by applicable law (e.g. the EU 14-day right of withdrawal for digital services, which you waive upon first use of the Service).
• If you experience a technical issue preventing use of the Service, contact us within 7 days at [email protected] and we will evaluate your case on its merits.
• Browser incompatibility, unsupported operating systems, or user-side configuration issues do not constitute technical failures of the Service and are not grounds for a refund.
• Prices may change with 30 days' notice to active subscribers.

7. Acceptable use

You agree not to:

• Upload illegal, harmful, or infringing content.
• Attempt to reverse-engineer, abuse, or overload the Service.
• Share or resell API keys.
• Use automated scripts or bots to exceed reasonable usage limits.
• Use the Service in a way that violates any applicable law or regulation.

We reserve the right to suspend or terminate access for violations without refund.

7a. Fair use — API and Pro plan

Paid plans, including the Pro plan, are intended for use on your own websites, applications, and projects. The following uses are not permitted on standard plans and require a separate commercial agreement:

• Reselling or white-labelling PuffPix compression as a service to third parties.
• Using the PuffPix API as the compression backend for a product or service you charge others for.
• Automated high-volume processing unrelated to your own content (e.g. bulk processing images on behalf of multiple end clients).

For high-volume or commercial API use, please contact [email protected] to discuss appropriate pricing. We will not suspend accounts without prior notice unless the abuse is severe or ongoing after warning.

8. Intellectual property

You retain full ownership of all images you upload. By using the Service you grant us a limited, temporary licence to process your images solely for the purpose of compression. We do not claim any rights to your content.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT RESULTS WILL MEET ANY SPECIFIC QUALITY OR FILE SIZE REQUIREMENT. WE DO NOT WARRANT THAT:

• THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE;
• COMPRESSED FILES WILL BE VISUALLY IDENTICAL TO ORIGINALS;
• ANY SPECIFIC FILE SIZE OR COMPRESSION RATIO WILL BE ACHIEVED;
• THE SERVICE WILL BE COMPATIBLE WITH ALL BROWSERS OR OPERATING SYSTEMS;
• ORIGINAL FILES WILL BE PRESERVED OR RECOVERABLE AFTER FOLDER MODE PROCESSING.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY DUTCH AND EU LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• LOSS OF ORIGINAL IMAGE FILES OR DATA;
• CORRUPTION OR UNINTENDED ALTERATION OF IMAGE CONTENT;
• LOSS OF PROFITS OR BUSINESS INTERRUPTION;
• FAILURE TO ACHIEVE A SPECIFIC OUTPUT FILE SIZE OR QUALITY;
• ANY DAMAGE ARISING FROM USE OF FOLDER (IN-PLACE) MODE.

IN ANY CASE, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Governing law

These Terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands.

13. Changes to these Terms

We may update these Terms from time to time. The current version is always at puffpix.com/terms.php. Continued use of the Service after changes constitutes acceptance of the new Terms. Material changes will be notified by email to active subscribers.
